
The Faculty of Law, Universitas Brawijaya (FH UB) held an open dissertation examination for Dr. Drs. Moh. Mujib, M.H., in the Auditorium of the 6th floor of Building, (10/6/2024). Moh. Mujib successfully graduated as the 575th Doctor of Law at FH UB.
The dissertation raised by Dr. Moh. Mujib discusses “The Authority of Religious Courts in Resolving the Problem of Determining Heirs in Indonesia with Differences in Legal Regulations that Classify Indigenous and Non-Indigenous Populations, and Differentiate Muslims and Non-Muslims Referring to Legal Norms”.
This open examination was attended by lecturers, students, and other invited guests, and was led by a board of examiners consisting of professors and leading legal experts.
In his presentation, Dr. Moh. Mujib outlined the complexity of the authority of religious courts in Indonesia, especially in determining heirs which are influenced by differences in legal regulations based on population and religious categories.
“The differences in existing legal regulations create dualism in determining heirs, where customary law and religious law play a role simultaneously but with different approaches,” explained Mujib.
He emphasized that this dualism often causes confusion and legal uncertainty for the community.

“Religious courts must be able to bridge these differences by applying universal principles of justice, regardless of the background of the population or their religion,” he added.
Dr. Moh. Mujib also highlighted the need for legal reform to unify the various existing regulations to create a more integrated and fair system.
“We need to move towards legal harmonization that not only respects cultural and religious diversity, but also ensures justice and legal certainty for all citizens,” he said.
The board of examiners gave high appreciation to Dr. Moh. Mujib’s research, which is considered capable of making a significant contribution to the development of legal science in Indonesia especially in the context of the authority of religious courts. (Rma/FH PR/OKY/UB PR/ Trans. Iir)
